General Terms and Conditions
Our General Terms and Conditions become binding upon submission of your order.

1. Scope of Application
1.1. The following General Terms and Conditions apply exclusively to the business relationship between Acceleration Hub GmbH, Schönbrunner Straße 38/8, 1050 Vienna, and the customer placing the order, provided the customer is a consumer as defined in §1 para. 1 Z2 of the Consumer Protection Act, in the version valid at the time of the order.
1.2. Our customer service can be reached for questions, complaints, and claims on weekdays from 9:00 AM to 6:00 PM at the telephone number +43 699 105 34 925 or via email at office@hmw-mobility.com.
1.3. Deviating conditions of the customer are not recognized unless Acceleration Hub GmbH has expressly agreed to their validity in writing.
2. Offers and service descriptions
2.1. The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. Service descriptions in catalogs and on the seller’s websites do not have the character of an assurance or guarantee.
2.2. All offers are valid “while supplies last,” unless otherwise noted on the product. Errors excepted.
3. Order process and contract conclusion
3.1. When ordering online, by clicking the “Order” button, or otherwise through your (digital) signature, you send us an offer to conclude a purchase contract. After we receive your order, we will send you an email (order confirmation) confirming receipt of your order and listing its details. This confirmation does not constitute acceptance of your offer but is intended to inform you that your order has been received.
3.2. A purchase contract is only concluded when you confirm this email with the listed products, payment terms, delivery dates and shipping costs and we send you a summary of the purchase contract with an invoice and cancellation policy in a second email (purchase confirmation). No purchase contract is concluded for products from one and the same order that are not listed in the purchase confirmation.
3.3. Acceleration Hub GmbH does not offer products for purchase by minors. Even our children’s products can only be purchased by adults.
4. Statutory right of withdrawal
4.1. Customers who are consumers as defined in §1 para. 1 Z2 of the Consumer Protection Act have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of the contract’s conclusion. To exercise the right of withdrawal, customers must inform us (Acceleration Hub GmbH, Schönbrunner Straße 38/8, 1050 Vienna, Austria) of their decision to withdraw from the contract using a clear statement (e.g., a letter sent by post or email to office@hmw-mobility.com). It is sufficient for customers to send a notification to exercise their right to withdraw before the withdrawal period expires.
4.2. If customers withdraw from the purchase contract, we shall refund all payments received from them, including delivery costs (except additional costs arising from choosing a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day we receive the notification of withdrawal. Refunds will be made using the same payment method as the original transaction unless expressly agreed otherwise. We may withhold the refund until we have received the goods back or until proof of return is provided, whichever is earlier.
4.3. The right of withdrawal does not apply to goods that are not prefabricated and for which an individual selection or determination by the consumer is decisive or that are tailored to the personal needs of the consumer.
5. Delivery and availability of goods
5.1. Unless otherwise agreed, delivery is made from the warehouse of Acceleration Hub GmbH to the delivery address specified by the customer. Delivery times are non-binding unless a binding delivery date has been expressly agreed upon.
5.2. If Acceleration Hub GmbH is unable to deliver the ordered goods due to its own fault or because its supplier has failed to meet contractual obligations, Acceleration Hub GmbH is entitled to withdraw from the contract. In this case, the customer will be informed immediately, and any payments already made will be refunded without delay.
5.3. If delivery to the customer is not possible for reasons such as the goods not fitting through the customer’s entrance, front door, or staircase, or if the customer is not present at the agreed delivery address despite being notified of the delivery time in advance, the customer shall bear the costs for the unsuccessful delivery.
5.4. Customers will be informed about delivery times and restrictions (e.g., delivery restrictions to certain countries) on a separate information page or within the respective product description.
5.5. Our sales prices, offers, and invoices are stated in euros. Internet offers are non-binding. All prices include applicable VAT. Shipping costs, unless specifically covered by the offer, are borne by the consumer.
6. Warranty, guarantee and liability
6.1. The warranty period is 24 months and is subject to statutory provisions.
6.2. Defects or damages caused by improper handling, installation, use of unsuitable accessories, or alterations of original parts by the customer or unauthorized third parties are excluded from the warranty.
6.3. Normal wear and tear due to use are also excluded from the warranty.
6.4. If the customer accepts the goods despite knowing about a defect, they are entitled to warranty claims only if the defect is reserved in writing (e.g., via email) immediately upon receipt of the goods.
6.5. A guarantee applies only if explicitly stated. Customers will be informed of the guarantee conditions before placing an order.
6.6. The above liability limitations do not apply if the damage was caused intentionally, through gross negligence, or if personal injury occurred.
6.7. Acceleration Hub GmbH is only liable for damages other than those resulting from injury to life, body, and health if these are based on intentional or grossly negligent actions or on culpable violation of an essential contractual obligation by Acceleration Hub GmbH. Acceleration Hub GmbH is therefore not liable for damage that did not occur to the delivery item itself; In particular, Acceleration Hub GmbH is not liable for lost profits or other financial losses to the customer. To the extent that the contractual liability of Acceleration Hub GmbH is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents.
6.8. The provisions of the Product Liability Act remain unaffected. If an essential contractual obligation is negligently violated, the liability of Acceleration Hub GmbH is limited to foreseeable damage.
6.9. If the subsequent fulfillment is carried out by way of a replacement delivery, the customer is obliged to return the goods that were first delivered to Acceleration Hub GmbH within 30 days at the expense of Acceleration Hub GmbH. The defective goods must be returned in accordance with legal regulations. Acceleration Hub GmbH reserves the right to claim damages under legally regulated conditions.
7. Payment terms
7.1. After placing the order, the customer must pay the deposit in advance (bank transfer). The bank details will be provided in the confirmation email.
7.2. The remaining amount will be invoiced when the purchase confirmation is created. Unless otherwise agreed in writing, Acceleration Hub GmbH’s invoices are payable immediately and without deductions, but at the latest before the products are handed over.
7.3. Acceleration Hub GmbH reserves the right to reject checks and other non-cash means of payment. Acceptance is always only on account of payment. Payments in foreign currency will be credited according to the bank statement. Bank fees are to be borne by the customer.
8. Retention of ownership
8.1. The delivered goods remain the property of Acceleration Hub GmbH until full payment has been made.
8.2. The customer is not entitled to sell the goods to third parties or to take other measures that endanger the property of Acceleration Hub GmbH until the purchase price has been paid in full.
9. Storage of the contract
9.1. The customer can print out the contract text before submitting the order to the seller by using the print function of their browser in the last step of the order.
9.2. The seller also sends the customer an order confirmation with all order details to the email address provided. With the purchase confirmation, but at the latest when the goods are delivered, the customer will also receive a copy of the general terms and conditions along with cancellation instructions and information on shipping costs as well as delivery and payment conditions. In addition, we store the text of the contract but do not make it accessible on the Internet.
10. Closing remarks
10.1. The place of jurisdiction and place of performance is the seller’s registered office.
10.2. The language of the contract is German.
